1. INTRODUCTION AND AGREEMENT

1.1 Overview

These Terms of Service ("Agreement" or "TOS") constitute a legally binding agreement between you ("Customer," "You," or "Your") and Hexraa, a division of Raahithya Group ("Hexraa," "We," "Us," or "Our"), governing your use of web hosting, domain registration, and related services ("Services").

1.2 Acceptance of Terms

By registering for, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including all policies incorporated by reference. If you do not agree to these terms, you must not use our Services.

1.3 Amendment of Terms

Hexraa reserves the right to modify, amend, or update this Agreement at any time at our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of the Services after any modifications constitutes acceptance of the amended Agreement. It is your responsibility to review this Agreement periodically. We recommend checking this document regularly for updates.

1.4 Service Agreement Formation

Placing an order through our website does not guarantee acceptance. Our acceptance of your order occurs when you receive confirmation that your order has been processed and activated. At that point, a binding contract is formed between you and Hexraa. Payment must be received before any Services are activated.


2. COMPANY INFORMATION AND CONTACT

Hexraa is a web hosting and domain registration provider operating under Raahithya Group. We are committed to providing reliable, secure, and high-quality hosting solutions to businesses and individuals worldwide.

2.3 Communication Methods

We will communicate with you via email, support tickets, or through your account dashboard. You agree to maintain accurate and current contact information, including a valid email address. We are not liable for communications not received due to incorrect contact information.

2.4 Current Contact Information Requirement

You must maintain accurate and up-to-date contact information, including your full name, address, email, and phone number. We rely on this information to contact you regarding network emergencies, maintenance, billing issues, and service updates. Failure to maintain current contact information may result in service suspension.


3. ACCOUNT REGISTRATION AND RESPONSIBILITIES

3.1 Account Creation

To access our Services, you must create an account by providing accurate, complete, and current information. You may be assigned login credentials, which we reserve the right to modify with written notice.

3.2 Account Security and Responsibility

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account, whether authorized or not
  • Preventing unauthorized access to your account
  • Implementing adequate security measures

You must notify us immediately of any unauthorized use or suspected security breach.

3.3 Identity Verification

We reserve the right to request government-issued identification or additional documentation to verify your identity, prevent fraud, and ensure compliance with applicable laws and regulations.

3.4 Reseller Responsibilities

If you operate as a reseller, you are responsible for all activities on sub-accounts created under your master account. You must ensure that your clients comply with this Agreement and all applicable policies.

3.5 Fraud Prevention

Orders that fail our fraud verification processes will not be fulfilled. We may request additional verification at any time. Providing false, inaccurate, or misleading information may result in immediate account termination without refund.


4. DOMAIN REGISTRATION AND MANAGEMENT

4.1 Domain Availability and Registration

We make no guarantees regarding the availability of specific domain names. Domains are always registered in your name, not Hexraa's. You are responsible for managing your domain's WHOIS data through your account dashboard and ensuring all information is accurate and current.

4.2 Designated Agent Authorization

For all applicable gTLDs, you authorize Hexraa to act as your Designated Agent in accordance with ICANN's Transfer Policy for updating registrant contact details. You grant us permission to approve changes to registrant information on your behalf.

4.3 Domain Registration Scope

Our service is limited to processing and forwarding your domain registration requests to the appropriate registry. You are solely responsible for ensuring that domains are registered, renewed, or transferred successfully. Hexraa accepts no liability for registration or transfer failures.

4.4 ICANN and Registry Compliance

Domain registration is subject to the terms and conditions of ICANN and the relevant registry for your domain extension. By ordering domain services, you confirm that you will comply with all ICANN and registry policies at all times. You agree to indemnify Hexraa for any failure to comply with these requirements.

4.5 Automatic Renewal

We will attempt to automatically renew your domain when it comes due for renewal, unless you have:

  • Submitted a cancellation request in accordance with this Agreement
  • Set the domain to manual renewal or cancellation in your control panel
  • Failed to provide a valid payment method

Domains will not be renewed if no valid payment method is available or if payment cannot be processed.

4.6 Renewal Periods and Pricing

Domains will renew for the same period as the initial registration unless you specify otherwise in writing or modify renewal settings in your account. Renewals are charged at the prevailing rate at the time of renewal. Payment for domain renewals will be processed up to 7 days prior to the renewal date to ensure timely renewal.

4.7 Domain Ownership Verification

Domain ownership is determined by the WHOIS database. If WHOIS information is inconclusive, we may request additional supporting evidence. You are responsible for resolving ownership disputes with third parties. We will not process transfer requests without proper authorization.

4.8 Domain Transfer Requirements

You are responsible for completing all steps required for domain transfers, including but not limited to:

  • Unlocking the domain
  • Obtaining and providing authorization codes
  • Approving transfer requests
  • Ensuring domain eligibility for transfer

You must contact us to cancel a transfer and request a refund in accordance with our refund policy.

4.9 Transfer Costs and Extensions

One year may be added to the registration period and charged when certain domain extensions are transferred. Some domains have maximum registration periods that may prevent transfer if the renewal would exceed the registry limit. Transfers will not be initiated until payment is received in full.

4.10 Domain Expiration

Domains not renewed by the expiration date will cease to operate and enter expired status. A domain expires if:

  • Payment cannot be processed via the provided method
  • You have set the domain to expire
  • You fail to manually renew before the renewal date

4.11 Grace Period

Following expiration, domains may enter a grace and/or redemption period. During the grace period (typically 30 days, depending on the registry), we may at our discretion:

  • Renew the domain
  • Change nameservers
  • Park the domain

For registries without a grace period, domains may become unrecoverable immediately upon expiration, terminating our agreement without liability.

4.12 Domain Redemption

If you contact us within the grace period to renew an expired domain, you must pay the renewal fee in full. Upon receipt of payment, we will restore the domain to your control panel as soon as reasonably practicable.

4.13 Post-Grace Period Actions

After the grace period ends, we may at our discretion:

  • Auction the domain
  • Transfer the domain
  • Change contact details

If we receive a renewal request during the redemption period (after the grace period), you agree to pay applicable redemption fees plus renewal fees. We are not obligated to attempt recovery and will only do so after receiving full payment. We make no guarantee that recovery attempts will be successful.

4.14 Domain Trademark and Copyright Compliance

You are responsible for ensuring that your domain registration and use does not:

  • Infringe upon third-party intellectual property rights
  • Constitute bad faith registration
  • Violate dispute resolution policies of any registry or ICANN

We may place a domain on hold if we receive a valid trademark or brand infringement complaint, or upon receipt of a decision from a domain dispute resolution service.


5. WEB HOSTING SERVICES

5.1 Intended Use

Unless explicitly stated otherwise, our hosting services are intended for hosting websites and email. The following uses are prohibited:

  • Batch processing or video encoding/transcoding
  • Web crawling or spidering activities
  • Archiving and online backup systems
  • Resource mining or cryptocurrency mining
  • Any system purpose other than standard website hosting

We reserve the right to take proactive measures to maintain system stability for all clients.

5.2 'Unlimited' and 'Unmetered' Allowances

Any services advertised as "unlimited" or "unmetered" are subject to fair use policies. Customers using excessive resources compared to average platform usage may be required to optimize their websites or upgrade to a more appropriate service tier. Excessive use will be determined at our discretion.

5.3 Service Adequacy Assessment

If we determine that your selected service does not meet your requirements, we will inform you and recommend an appropriate alternative. We are not obligated to continue providing services inadequate for your needs. Refusal to cooperate with upgrade recommendations may result in account suspension or termination.

5.4 Free Migration Service

We offer complimentary migration assistance from your previous provider on a best-effort basis. You acknowledge that:

  • You are most familiar with your website's requirements
  • We cannot know the intricacies of every website we host
  • You must provide suitable access for data retrieval
  • You are responsible for verifying successful migration
  • We aim to complete migrations within 72 hours but do not guarantee any specific timeframe
  • We may be able to migrate emails, DNS records, and domains, but we do not warrant successful migration without interruption

5.5 Hosting Environment Modifications

We reserve the right to modify the hosting environment on a like-for-like basis without affecting your service. Material changes will only be made to provide upgrades. You will be notified in writing of any significant changes to your hosting environment.

5.6 Server Location

We offer various server locations and reserve the right to make substitutions when necessary. Your desired location may not always be available, or we may need to relocate your account to an equivalent location at our discretion.

5.7 Bandwidth and Data Transfer

Bandwidth and data transfer are considered unmetered and subject to fair use policies. No customer may use what we deem excessive transfer in shared or reseller hosting environments.

5.8 DDoS Protection

While we implement DDoS mitigation measures, we cannot guarantee protection against every attack, as attack methods constantly evolve. If you believe you may be targeted by DDoS attacks, we recommend purchasing third-party DDoS mitigation services such as Cloudflare's paid plans.

5.9 Service Uptime Commitment

We strive to provide 99.9% service uptime, excluding planned maintenance, emergency maintenance, or circumstances beyond our reasonable control. Planned maintenance will be announced through our status page whenever possible. In the event of service issues, a qualified engineer will address the problem within 30 minutes of notification.

5.10 Uptime Guarantee

While we aim for 100% uptime, certain hardware and system failures may cause unavoidable outages. Affected customers may request a 25% account credit for documented downtime upon request.

5.11 Backup Services

We perform regular backups of account data and store them offsite, typically in the same geographic region as your live server. We may exclude non-essential files such as error logs, cache files, and duplicate backups. Backups are provided on a best-effort basis and are not guaranteed to be complete or regular. You are solely responsible for maintaining your own backups.

5.12 Service Disruption Disclaimer

We are not responsible for service disruptions beyond our control, including but not limited to upstream network issues, data center provider problems, natural disasters, or acts of third parties. We will make reasonable efforts to minimize disruption and notify you via our status page. Such disruptions are excluded from uptime calculations.


6. ACCEPTABLE USE POLICY

6.1 Server and Network Abuse

Any attempt to undermine, harm, or compromise our servers, network, or customers is strictly prohibited. This includes but is not limited to:

  • Unauthorized access to accounts or computers
  • Password theft or cracking
  • Security vulnerability scanning without authorization
  • Internet scamming or phishing
  • Exploiting security holes

Violations will result in warnings, account suspension or termination, and potential civil or criminal legal action.

6.2 Prohibited Content

You may not host, distribute, or transmit:

  • Content that is grossly offensive, including expressions of bigotry, racism, hatred, or discrimination
  • Instructional information about illegal activities
  • Content promoting physical harm or violence
  • Material exploiting minors under 18 years of age
  • Copyrighted material, including pirated software, music, videos, or links to such content
  • Serial numbers, cracks, or circumvention devices for copy-protected software
  • Warez, nulled scripts, or pirated content
  • Information regarding creation or distribution of malware, viruses, or denial-of-service attacks
  • Proxy servers or anonymization services
  • HYIP (High-Yield Investment Programs) or fraudulent investment schemes

6.3 Child Protection

We maintain a zero-tolerance policy regarding child pornography and child exploitation material. We will fully cooperate with law enforcement in any investigation. Violations will result in immediate account termination and reporting to appropriate authorities.

6.4 IRC and Chat Services

Operation of IRC (Internet Relay Chat) servers, chat networks, IRC clients, or IRC bots is strictly prohibited on our servers and may result in immediate account termination.

6.5 Resource Abuse

Shared hosting accounts are subject to resource usage limitations. Resource abuse includes excessive CPU, memory, disk I/O, concurrent processes, port connections, database connections, or bandwidth usage that disrupts normal server operations. Offending scripts, services, or accounts may be disabled without prior notice if server stability is threatened.

6.6 Email Usage and Anti-Spam Policy

Zero-Tolerance Spam Policy: We maintain a zero-tolerance policy against spam and unsolicited commercial email. Violations may result in immediate account suspension or termination without refund.

Prohibited email activities include:

  • Sending unsolicited bulk or commercial messages (spam)
  • Email marketing without explicit recipient consent
  • Header manipulation or forging sender information
  • Mail bombing or overwhelming recipients with messages
  • Spamming newsgroups or mailing lists
  • Email harassment or intimidation
  • Providing or linking to spamware or email harvesting tools
  • Collecting email addresses without owner consent
  • Operating unconfirmed mailing lists (all lists must use confirmed opt-in)
  • Associating with entities listed in the Spamhaus ROKSO database
  • Snowshoe spamming (distributing spam across multiple IPs or domains)

Spamvertising: If external services are used to promote websites hosted by Hexraa, this policy applies as if the spam originated from our servers.

Blacklist Consequences: If your actions cause Hexraa to be blacklisted or blocked, we reserve the right to suspend or terminate services. Customers responsible for blacklisting may be charged for remediation efforts (minimum $200 plus $100 per hour).

6.7 Reverse DNS and PTR Requests

All PTR (pointer) requests must be associated with valid, live domains hosting actual content. We do not accept PTR requests for:

  • Domains without web content
  • Anonymous mail sending
  • Entries with snowshoe characteristics

6.8 Network Security Requirements

You must not attempt to:

  • Circumvent authentication or security measures of any host, network, or account
  • Access data not intended for you
  • Crack passwords or forge TCP/IP packet headers
  • Probe, scan, or test system vulnerabilities without authorization
  • Interfere with or deny service to any user, host, or network
  • Engage in flooding, mail bombing, or deliberate system crashes

We will fully cooperate with investigations of security violations, including law enforcement authorities. You are liable for any security breaches affecting servers or accounts under your control.

6.9 Intellectual Property Rights

Content accessed through our Services may be protected by copyright, trademark, or other intellectual property laws. You must not use our Services in any manner that infringes, violates, or misappropriates such rights. If you use a domain name with our Services, you must ensure it does not infringe upon third-party trademark or service mark rights.

6.10 Adult Content

Legal adult content as defined by applicable law is permitted with prior approval. You must contact us before uploading any adult content. We reserve the right to decline service at our absolute discretion.

6.11 Content Investigation and Removal

We reserve the right to investigate content if potential abuse is reported and to remove any content from our servers at any time for any reason. Accounts found to contain illegal content or violations of this Agreement are subject to immediate termination.

6.12 Copyright Infringement and DMCA

Digital Millennium Copyright Act Compliance:

All notifications of alleged copyright infringement must be directed to our designated DMCA agent:

  5. A statement of good faith belief that use is unauthorized
  6. A statement under penalty of perjury that the notification is accurate and the complainant is authorized to act

Warning: Knowingly making false copyright infringement claims may result in severe civil penalties under federal law, including monetary damages, court costs, and attorney's fees.


7. PAYMENT TERMS AND BILLING

7.1 Pricing and Service Terms

Service pricing is as displayed on our website at the time of order. Prices are guaranteed for the prepaid term. Hexraa reserves the right to modify pricing at any time for new and renewal orders.

7.2 Prepayment Requirement

All accounts are established on a prepaid basis. Services will not be activated until payment is received in full.

7.3 Payment Methods

We accept payment via:

  • Major credit and debit cards
  • PayPal
  • Cryptocurrency (where applicable)
  • Other methods as specified on our website

You warrant that you are legally authorized to make payments using the selected method.

7.4 Invoicing

Invoices are generated 10 days prior to the due date and emailed to your registered email address. We will attempt automatic renewal 5 days before the due date using the payment method on file.

7.5 Late Payment and Suspension

Payment is due on the invoice due date. We offer a 5-day grace period, after which:

  • A late fee of 7% of the invoice amount or $2 (whichever is greater) will be applied
  • Services may be suspended for non-payment
  • Access may be restricted until payment is received

Accounts not brought current within 7 days of notification may be fully deactivated. You remain responsible for all charges until you formally request cancellation.

7.6 Payment Arrangements

If you cannot pay within the grace period, contact us to establish a payment arrangement. Arrangements require:

  • Payment of 50% of the outstanding balance (excluding late fees)
  • Agreement to full payment terms
  • A $25 reactivation fee if service is suspended due to non-payment under the arrangement

7.7 Chargebacks and Returned Payments

Chargebacks or returned checks will result in:

  • Immediate suspension of all associated services
  • A $35 fee per chargeback or returned check
  • Requirement of full payment including fees before service restoration
  • Potential account termination for repeated incidents

7.8 Pricing Errors

If we provide incorrect pricing:

  • If the correct price is lower, we will refund the difference
  • If the correct price is higher, we will contact you before accepting the order
  • You may choose to proceed at the correct price or cancel the order

7.9 Overage Charges

Excess bandwidth usage beyond your plan's allocation will incur charges of $0.05 per GB. Overage charges are billed at the start of each month.


8. CANCELLATION AND REFUND POLICY

8.1 Service Cancellation

To cancel your service, you must submit a cancellation request through your account dashboard before the renewal date. Cancellations via email, phone, or chat will not be accepted. Cancellations are processed immediately upon submission.

You remain responsible for all charges until formal cancellation is submitted. Cancellations must be submitted before the renewal date to avoid automatic renewal charges.

8.2 30-Day Money-Back Guarantee

Eligible services may be refunded within 30 days of the original order date. The following are NOT eligible for refunds:

  • Domain registration and transfer fees
  • Add-on services
  • Product licenses (including control panel licenses)
  • Dedicated servers
  • VPS servers
  • Orders using promotional codes or discounts (if specified in promotion terms)

Payment processing fees will be deducted from refund amounts.

8.3 No Refund for Unused Service Periods

Hexraa does not provide prorated refunds for unused portions of service terms, except as explicitly stated in this Agreement.

8.4 Automatic Renewal Refund Window

If an annual or longer-term service automatically renews, you have a 5-day window to request cancellation and receive a refund, minus one month charged at the standard monthly rate.

8.5 Service Defects

If Services are faulty or materially different from what was described, you may have legal rights to end the contract or receive corrected service. You must notify us in writing with detailed explanation of the issue.

8.6 Termination for Violations

If your account is terminated for policy violations, illegal activity, or prohibited content, no refunds will be issued, and you may be liable for additional costs incurred.


9. SERVICE MODIFICATIONS AND TERMINATION

9.1 Right to Suspend or Disable Services

We may suspend or disable Services without prior notice if:

  • Technical problems or maintenance require it
  • Updates are needed to comply with laws or regulations
  • You request changes or modifications
  • Required by law or legal process
  • You breach material terms of this Agreement
  • Third-party claims or actions necessitate it
  • Suspension is necessary to avoid financial loss or legal liability

9.2 Advance Notice

We will provide advance notice of service suspension unless the issue is urgent or constitutes an emergency. If suspension exceeds 24 hours in any 7-day period (except for breaches on your part), we will adjust billing accordingly.

9.3 Suspension for Non-Payment

If you fail to pay invoices when due, we may suspend Services until payment is received in full. We will notify you before suspension. Interest may accrue on overdue amounts. Services will be restored within 24 hours of receiving payment, using reasonable efforts.

9.4 Our Right to Terminate

We may terminate this Agreement by providing written notice if:

  • You fail to make required payments
  • You fail to provide necessary information
  • You breach material terms of this Agreement
  • We discontinue providing the Services (with at least 30 days' notice)

9.5 Compensation for Breach

If we terminate due to your breach, you must compensate us for reasonable costs incurred. We may refund prepaid amounts for undelivered Services but may deduct compensation for breach-related costs.


10. LIMITATION OF LIABILITY AND INDEMNIFICATION

10.1 Disclaimer of Warranties

Services are provided on an "AS IS" and "AS AVAILABLE" basis. Hexraa makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the maximum extent permitted by law, Hexraa's total liability for any claims arising from or related to this Agreement or the Services shall not exceed the amount paid by you for Services during the 12 months preceding the claim.

10.3 Exclusion of Consequential Damages

Hexraa shall not be liable for:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or business interruption
  • Indirect, incidental, special, consequential, or punitive damages
  • Damages resulting from service unavailability, data corruption, or deletion
  • Any losses resulting from circumstances beyond our reasonable control

10.4 Data Loss and Backup Responsibility

Your use of our Services is at your own risk. You are solely responsible for maintaining backups of all data and files. While we may perform backups for disaster recovery purposes, we do not guarantee availability, completeness, or integrity of backups for individual customer data.

10.5 Customer Indemnification

You agree to defend, indemnify, and hold harmless Hexraa, Raahithya Group, and their officers, employees, agents, and customers from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Services
  • Your violation of this Agreement
  • Your violation of any third-party rights, including intellectual property rights
  • Content you host, transmit, or distribute through our Services
  • Products or services sold or distributed via your website
  • Your violation of any applicable laws or regulations

10.6 Force Majeure

Hexraa shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or failures of third-party infrastructure providers.


11. INTELLECTUAL PROPERTY AND CONTENT

11.1 Your Content Ownership

You retain all intellectual property rights to content you upload, publish, or transmit through our Services. By using our Services, you grant Hexraa a limited, non-exclusive license to host, cache, store, and display your content as necessary to provide the Services.

11.2 Content Responsibility

You are solely responsible for:

  • The legality, accuracy, and appropriateness of your content
  • Ensuring content does not infringe third-party rights
  • Verifying you have necessary permissions and licenses
  • Compliance with all applicable laws and regulations

11.3 Prohibited Content Activities

You must not use our Services to host, transmit, or distribute:

  • Content that infringes copyright, trademark, or other intellectual property rights
  • Content that violates privacy or publicity rights
  • Content that is illegal under applicable law
  • Defamatory, libelous, or fraudulent material

11.4 IP Address Ownership

Hexraa retains ownership and control of all IP addresses assigned to your account. We reserve the right to change or remove assigned IP addresses at our sole discretion. You may only use IP addresses officially assigned by Hexraa staff. Unauthorized use of IP addresses will result in immediate network suspension.

11.5 Static and Dynamic Content Caching

By using our Services, you grant Hexraa a license to cache your entire website, including third-party content, to improve performance. You acknowledge that caching does not infringe your intellectual property rights or the rights of any third party.


12. MISCELLANEOUS PROVISIONS

12.1 Entire Agreement

This Agreement, including all incorporated policies and documents, constitutes the entire agreement between you and Hexraa and supersedes all prior agreements, understandings, and communications regarding the Services.

12.2 Assignment

You may not transfer or assign your rights or obligations under this Agreement without prior written consent from Hexraa. Hexraa may assign this Agreement, in whole or in part, at any time without your consent.

12.3 Severability

If any provision of this Agreement is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

12.4 Waiver

Failure by Hexraa to enforce any provision of this Agreement shall not constitute a waiver of that provision or our right to enforce it in the future. No waiver shall be effective unless made in writing and signed by an authorized representative of Hexraa.

12.5 Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. You agree that any disputes arising from this Agreement or the Services shall be resolved exclusively in the courts of [Your Jurisdiction], and you consent to the personal jurisdiction of such courts.

12.6 Third-Party Rights

This Agreement is between you and Hexraa only. No third party has any rights to enforce any terms of this Agreement.

12.7 Survival

Provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to payment obligations, indemnification, limitations of liability, and dispute resolution provisions.

12.8 Independent Relationship

Nothing in this Agreement creates a partnership, joint venture, agency, or employment relationship between you and Hexraa. You are an independent customer of our Services.

12.9 Notices

All notices required under this Agreement must be in writing and delivered via email to the address associated with your account or via your account dashboard. Notices to Hexraa should be sent to our designated contact addresses.
